Texas Cottage Food Labeling Requirements (DSHS Rules)
To legally sell homemade foods in Texas (like cookies, breads, jams, or dried herbs), state law requires these five elements on every package:
- Mandatory DisclaimerYour label must include this exact statement printed in ALL CAPS:THIS PRODUCT WAS PRODUCED IN A PRIVATE RESIDENCE THAT IS NOT SUBJECT TO GOVERNMENTAL LICENSING OR INSPECTION.
- Business Identification: Your business name and physical home address. (Note: If you registered with DSHS, you can use your official DSHS Unique ID on the label instead of your personal address).
- Product Name: The common name of the item (e.g., "Chocolate Chip Cookies", not a vague brand name like "Midnight Crunch").
- Ingredients & Allergens: Ingredients listed in order by weight (heaviest first). You must declare any of the 9 major allergens present: Milk, Eggs, Peanuts, Tree Nuts, Wheat, Soy, Sesame, Fish, or Shellfish.
- Net Weight & Dates: Net weight or net volume. If you sell refrigerated baked goods or pickled items, you must also include the date made or batch number.
